medical malpractice

What is the definition of medical malpractice?

By law medical malpractice is when a healthcare provider has failed to provide a patient with the care that is within the accepted standards of practice in the community of medicine. Not only is medical malpractice dangerous for the patient, but it can also result in permanent injury or in the worst cases death of a patient.

Examples of medical malpractice can be found in many areas such as prescription/medication errors, injuries at birth, surgical errors, a misdiagnosis, or even neglect in a nursing home. If a person does not have a medical background, it is often hard to for someone to see the negligence in the health care that is being provided. This is where professional guidance and the needs of an expert are important to understanding whether or not a person has a case for medical malpractice.

There are many types of medical malpractice and most fall into one of the following three categories:

  1. A misdiagnosis: When a doctor misses a patient’s illness, or makes an improper diagnosis, which could lead to a different outcome due to the misdiagnosis.
  2. Failure to warn a patient of known risks involved: A doctor has a duty to his or her patient to disclose any known risks from treatments or procedures.
  3. Improper Treatment: If the care provided by a doctor is not within the accepted standards of practice in the community of medicine.
