How long will my personal injury lawsuit take?
Each case is unique, some will only take a few months to settle without the need for a trial. There are other cases that will take over a year to resolve. There is no timetable for personal injury cases, it will depend on how much evidence is submitted, as well as cross examining, and the appeal process.
How much can I win through my personal injury case?
This is similar to the previous answer, it depends. How severe are the injuries? What kind of bills have you paid for your injuries thus far? There are 5 categories that will determine how much you will be paid. These five are: Past medical bills, future medical bills, pain and suffering, lost wages, and loss of earning capacity. It will depend heavily on the extent of the injury, and if it has gotten worse or better since the time of the injury. The compensation amount will also depend on the degree of the plaintiff’s fault, employment history, ability to work, and life expectancy.
Can I still pursue compensation if I am partially at fault for these injuries?
Yes you can still pursue compensation even if you are partially at fault. The compensation may be decreased since you are still at partial fault, but compensation will still be rewarded.
What is negligence?
This is something we discussed in the Medical Malpractice blog, negligence occurs when the individual who caused the injury, fails to exercise a reasonable standard of care for the safety of others. If that person does not react like a reasonable person would, then that person may be responsible for the negligent care of the victim.
What does it mean to file suit?
This is simply the act of filing legal papers at the courthouse. Many times, the case can be settled before even beginning the trial, however, once the client gives authorization to file suit, it means that all other options have been exhausted in the pre-suit.
How soon should I file a lawsuit?
